Same-Sex Marriages in California Put on Hold Again

After a federal judge overturned California’s ban on same-sex marriages, the U.S. Court of Appeals for the Ninth Circuit has issued an emergency stay pending an appeal. The stay will prevent California from issuing marriage licenses to same-sex couples while the appellate court is deciding the issues. California was to begin issuing same-sex marriage licenses this week after District Judge Vaughn Walker refused to issue a stay.


Proposition 8 was passed in November 2008. The measure amended the California Constitution to overrule a state Supreme Court ruling that legalized same-sex unions earlier that year. Oral arguments in the appeal are scheduled to begin in December.
